Generative AI has the potential to have positive effects on the legal field, but this means attorneys must understand the technology to use it well and within the ethical obligations of the legal profession. This CLE will discuss basics of AI, ethics rules that apply to use in legal practice, and cases that illustrate where attorneys have used it improperly. This CLE will ensure attorneys are up to date on how these topics have recently been addressed by courts and bar associations. We will cover the following ABA Model Rules of Professional Conduct: 1.1 (Competence) 1.3 (Diligence) 1.4 (Communications) 1.5 (Fees) 1.6 (Confidentiality of Information) 3.3 (Candor toward the Tribunal) 5.1 (Responsibilities of Partners, Managers, and Supervisory Lawyers) 5.3 (Responsibilities Regarding Nonlawyer Assistance) 8.4 (Misconduct) We will also discuss the work being done on this issue by the ABA and state bar associations, highlighting the Florida Bar Ethics Opinion 24-1. The following cases are part of the presentation, as well, since they highlight pitfalls of AI use in the legal profession that others should avoid: Mata v. Avianca United States v. Michael Cohen Colorado v. Crabill Smith v. Farwell United States v. Prakazrel Michel This CLE will give you an overview of the ethical considerations necessary for lawyers who use AI in their legal practice, which will likely grow significantly as AI programs specifically created for law firms are offered.
