DESCRIPTION: Most litigated workers' compensation claims turn on competing medical opinions, which makes understanding the applicable causation standard the essential first step in evaluating any claim. Yet the standard that applies, and what it actually requires, is often misunderstood, even by practitioners who handle these claims regularly. Getting it wrong doesn't just create problems at hearing; it can undermine claim handling from the very beginning. This CLE walks through the foundational causation standards in workers' compensation, starting with the distinction between legal causation and medical causation. Participants will learn which standard applies to which claim type. The course gives practical guidance for evaluating and developing medical evidence, since a claim is only as strong as the medical opinions behind it. Participants will learn how to frame questions to treating and evaluating physicians, how to identify red flags in medical opinions, and how to build a medical record that can withstand scrutiny at hearing. Whether approaching a claim from the injured worker's side or the defense side, participants will leave with the tools to identify the correct standard early and build their case around it.
