DESCRIPTION: "To be a good lawyer, one has to be a healthy lawyer." -- Report from the National Task Force on Lawyer Well-Being Many lawyers struggle with the stress and anxiety of practicing law, which can directly impact their ability to perform legal services competently. In 2017, the ABA National Task Force on Lawyer Well-Being issued a report titled The Path to Lawyer Well-Being: Practical Recommendations for Positive Change. The report identified mindfulness as a way to "enhance a host of competencies related to lawyer effectiveness, including increased focus and concentration, working memory, critical cognitive skills, reduced burnout, and ethical and rational decision-making." John Devlin had been litigating for almost two decades when he became interested in mindfulness as a way to deal with stress and anxiety in his legal practice. He discovered that becoming more mindful also made him a more effective lawyer in the context of practicing law. He was more present when talking to clients and witnesses, able to respond rather than react to difficult situations, and could remain calm during stressful moments like depositions and trials. He also uses mindfulness skills in his mediation practice. In this CLE, John shares what he has learned about mindfulness and how mental wellness and stress management directly impact an attorney's competence in performing legal services. He offers practical tips on how to get started with mindfulness practice and provides an overview of the scientific research. You do not need any prior experience – just curiosity about the topic.
