DESCRIPTION: Managing personnel in a union environment requires attorneys and HR professionals to navigate a distinct set of rules. Getting this wrong can turn a routine personnel decision into a grievance, an unfair labor practice charge, or a due process claim. This CLE provides a practical guide to labor relations, performance management, and discipline in a unionized workplace. Participants will review the foundational legal framework, including the Fair Labor Standards Act, the National Labor Relations Act, and state labor relations boards, along with the employer's duty to bargain in good faith and the distinction between mandatory and permissive subjects of bargaining. The program then turns to performance management, covering coaching versus formal discipline, Performance Improvement Plans, and the seven tests of just cause that govern whether discipline will hold up to scrutiny. The course closes with a detailed walkthrough of progressive discipline and the employee rights that attach at each stage, including Weingarten rights to union representation during investigatory interviews and Loudermill rights to a pre-termination hearing for public employees. Participants will leave with concrete documentation practices, covering training records, investigation findings, non-retaliation language, and comparison cases, that protect both the employee's rights and the employer's position if discipline is challenged.
