DESCRIPTION: Psychological evaluations can be a powerful tool in immigration cases, especially when used strategically. This CLE explores how and when evaluations can strengthen a case, and when they may add little value. The burden of proof for different types of cases, from asylum applications to U-Visas, is discussed to highlight the burden that must be met for someone to be granted relief in immigration proceedings. Through case examples, we will examine the different weight evaluations may carry before an immigration judge or a USCIS adjudicator, as well as what factors make reports persuasive in each setting. You will also learn how evaluators gather and present information using trauma-informed practices that minimize harm and ensure accuracy. Attorneys will gain insight into what to expect from an objective, trauma-sensitive evaluation, and how to collaborate with evaluators so that reports address the issues most relevant to adjudicators. Ways that attorneys and evaluators can find corroborating documentation is highlighted because the information assists in the evaluation process and can be critical to the adjudicator’s decision-making process. In addition, the program will highlight how attorneys themselves can integrate trauma-informed approaches into client interactions and case strategy, building trust while strengthening case presentation.
