DESCRIPTION: This ethics CLE examines the professional responsibility obligations attorneys face when mistakes occur in legal practice. The course addresses attorney duties related to disclosure obligations, withdrawal requirements, and the consequences of ethical violations in attorney discipline proceedings. Through analysis of recent disciplinary cases and authoritative ethics opinions from the ABA and state bars, this program demonstrates how attorneys' responses to errors can impact discipline results. The presentation provides practical guidance for maintaining compliance with professional conduct rules when mistakes occur, including protocols for error assessment, client disclosure, and conflict analysis. Attorneys will learn to apply the "disinterested lawyer" standard to assess when errors require disclosure, recognize psychological factors that lead to cover-up behavior, implement protocols for responding to discovered errors, analyze when errors create conflicts requiring withdrawal, and understand aggravating and mitigating factors that affect disciplinary outcomes. This CLE will ensure attorneys understand their ethical obligations when errors arise and can implement systems to prevent mistakes from escalating into serious disciplinary violations.
